Welcome to Fanbase.com. This Privacy Policy outlines how Fanbase ("we," "us," "our") collects, uses, processes, and discloses your information in relation to your access to and use of the Fanbase.com platform and services (collectively, the "Services").

By accessing or using our Services, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms of Service.

2. Information We Collect

We collect personal information to provide and improve our Services. The types of information we collect can be categorized as follows:

2.1. Information You Provide to Us Directly

This is personal information that you give to us when you register for an account, set up your profile, or communicate with us.

Account Registration Data: The personal information we collect at registration depends on the sign-up method you select.

  • Crypto Wallet Sign-Up: If you create an account by connecting a cryptocurrency wallet, we will collect your public Wallet address as a primary identifier.
  • Email Sign-Up: If you choose to register using an email address, we will collect your email address. Authentication is managed by our third-party provider (Dynamic.xyz); consequently, we do not directly collect or store user passwords.
  • Third-Party Authentication: If you register using a third-party service (e.g., Google), we will collect information from that service as described in Section 2.3, which may include your name and email address.

Profile Data: You may voluntarily add further information to your public profile, such as a username, profile picture, header image, and a biography.

Creator-Specific Data: To operate as a Creator and receive earnings, you must provide a compatible cryptocurrency Wallet address if you have not already done so during registration. We do not require government-issued identification or other formal KYC (Know Your Customer) documents as a standard prerequisite for account creation. However, we reserve the right to request identity verification information in specific circumstances, such as to comply with our statutory and legal obligations or to investigate violations of our Terms of Service.

Content Data: We collect the content you upload to the Services, including photos, videos, audio, text, and associated metadata. This also includes any content you create as part of a direct message.

Communications Data: We collect information when you communicate with us for customer support or other inquiries, including the content of your communications.

2.2. Information We Collect Automatically

This is information collected automatically as you use the Services.

Usage Data: We collect information about your interactions with the Services, such as the pages you view, the Content you purchase, the features you use, and the time, frequency, and duration of your activities.

Technical Data: We collect technical information from your device, including your IP address, browser type and version, device information, operating system, and time zone setting.

Blockchain Transaction Data: When you, as a Fan, make a Content Purchase, or as a Creator, receive Creator Earnings, we collect information about the transaction. This includes the public addresses of the sender and receiver Wallets, the transaction hash (ID), the amount of cryptocurrency transferred, and the transaction timestamp. Please note that this information is public and permanently recorded on the applicable blockchain.

2.3. Information We Collect from Third Parties

  • Analytics Providers: We may receive information from third-party analytics providers (such as Google Analytics) about traffic and usage trends for the Services. These providers collect information sent by your device or our Services and assist us in improving the platform.
  • Social Media: If you choose to register or log in to our Services using a third-party service (e.g., Google), that service may send us information such as your name and email address from your profile on that service, in accordance with your privacy settings on that service.

3. How We Use Your Personal Information

We use the information we collect for the following purposes:

  • To Provide and Manage the Services: To set up your account, facilitate Content Purchases via our Smart Contract, process payments, display Content, and manage your profile.
  • To Enforce our Terms and Policies: To ensure compliance with our Terms of Service and Acceptable Use Policy, and to investigate and address any potential violations.
  • To Communicate With You: To provide you with customer support, send you service-related notices (e.g., account verification, security alerts), and respond to your inquiries.
  • For Analytics and Service Improvement: To monitor and analyse trends, usage, and activities in connection with our Services to understand our user base and improve our platform.
  • For Security and Fraud Prevention: To protect the security and integrity of our Services, our users, and our platform, including by detecting and preventing fraudulent or malicious activity.
  • For Legal Compliance: To comply with applicable legal obligations, legal processes, and lawful requests from public and government authorities.

4. Who We Share Your Personal Information With

We do not sell your personal information. We may share your information with the following parties under limited circumstances:

  • Other Users of the Services: Your username and public profile information are visible to all Users of the Services. Creators can see the usernames of Fans who have made a Content Purchase from them.
  • Third-Party Service Providers: We share information with third-party vendors and service providers that perform services on our behalf, such as cloud hosting (e.g., Amazon Web Services), data analytics, and security services. These providers are given access to your information only as is reasonably necessary to provide the service under contractual confidentiality obligations.
  • Law Enforcement and Legal Authorities: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect and defend our rights or property, (c) prevent or investigate possible wrongdoing in connection with the Services, or (d) protect the personal safety of Users or the public.
  • In Connection with a Business Transaction: We may share, sell, or transfer your information in connection with a business transaction, such as a merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. You will be notified via email and/or a prominent notice on our Services of any change in ownership or uses of your personal information.

5. Data Storage and International Transfers

Your information may be stored and processed in any country where we have facilities or in which we engage service providers. By using the Services, you understand that your information may be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. When we do so, we will ensure that adequate safeguards are in place to protect your information, such as by using Standard Contractual Clauses (SCCs) as approved by the European Commission.

6. Data Retention

We will retain your personal information for as long as your account is active or as needed to provide you with the Services. We may also retain your personal information for an additional period as is necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Important Note on Blockchain Data: Information related to cryptocurrency transactions, including your public Wallet address and transaction hashes, is permanently recorded on the public blockchain. This data cannot be altered or deleted by us or anyone else.

7. Your Rights and Choices

Depending on your location and subject to applicable law, you may have the following rights with regard to your personal information:

  • Right to Access: You have the right to request a copy of the personal information we hold about you.
  • Right to Rectification: You have the right to request that we correct any inaccurate or incomplete personal information.
  • Right to Erasure (Right to be Forgotten): You have the right to request that we delete your personal information, subject to certain exceptions. For example, we cannot erase transaction data from the blockchain and may need to retain certain information for legal compliance.
  • Right to Restrict Processing: You have the right to request that we restrict the processing of your personal information under certain conditions.
  • Right to Data Portability: You have the right to receive the personal information you have provided to us in a structured, commonly used, and machine-readable format.
  • Right to Object: You have the right to object to our processing of your personal information under certain conditions.

We use cookies and similar tracking technologies to track the activity on our Services and hold certain information. However, if you do not accept cookies, you may not be able to use some portions of our Services.

9. Security of Your Information

We use reasonable technical and organizational measures to protect the personal information that we collect and process. However, no electronic transmission or storage of information can be entirely secure. We cannot guarantee the absolute security of your personal information.

10. Children's Privacy

Our Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information from our files as soon as possible.
